Welcome to North & Noel.
North & Noel is a trading name operated by Mavo Music AS, a company registered in Norway. The terms “we”, “us” and “our” refer to North & Noel and Mavo Music AS.
North & Noel operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they contain important information about your legal rights and responsibilities.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access the Services.

We make reasonable efforts to display our products as accurately as possible.
However, colours, dimensions, print placement and product appearance may vary slightly from what is shown on your screen due to differences in displays, manufacturing processes and the nature of made-to-order production.
Many North & Noel products are produced individually after an order is placed.
Small variations between products do not necessarily constitute a defect.
All product descriptions, specifications, availability and designs may be updated or changed from time to time.
We reserve the right to discontinue products or limit availability in certain countries, regions or jurisdictions.
Nothing in this section limits your rights in relation to defective, damaged, incorrectly supplied or non-conforming goods under applicable consumer law.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase products from us.
An order is accepted when we confirm the order and successfully process the required payment.
Please review your order carefully before submitting it, including product, size, colour, quantity and delivery information.
Because many products are made to order, it may not be possible to cancel or modify an order once production has started.
If we are unable to accept or fulfil your order, or if we need to make a material change to it, we will attempt to contact you using the information provided with your order.
Returns, refunds and exchanges are governed by our Return & Refund Policy, subject always to any mandatory rights available under applicable law.
Products purchased through North & Noel are intended primarily for personal or household use unless otherwise agreed.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice.
The price charged will normally be the price displayed at the time your order is submitted and confirmed.
Depending on your location, prices may be displayed in your local currency.
Shipping costs, taxes, duties, customs fees and import charges may be shown separately where applicable.
Where required by law or the configuration of our store, applicable taxes may be included in the displayed price or calculated during checkout.
For international orders, additional customs duties, import taxes or fees may apply depending on the destination country. Unless stated otherwise during checkout, such charges may be the responsibility of the customer.
You agree to provide current, complete and accurate billing and payment information.
You confirm that you are authorised to use the payment method provided for your purchase.
SECTION 5 - SHIPPING AND DELIVERY
Orders are produced and shipped through our fulfilment partners.
Production and delivery times shown on our website or during checkout are estimates unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, weather events, public holidays, incorrect delivery information and other logistical disruptions.
We are not responsible for delays caused solely by circumstances outside our reasonable control, subject to any rights you have under applicable law.
Please ensure that your delivery address is accurate and complete before submitting your order.
Risk of loss or damage passes to you when the goods are delivered to you, except where applicable law provides otherwise.

Our Services, including trademarks, brand elements, text, illustrations, graphics, photographs, product designs, videos, audio, website design and other content, are owned by or licensed to North & Noel and/or Mavo Music AS and are protected by applicable intellectual property laws.
Unless otherwise permitted by law, you may not reproduce, distribute, modify, republish, commercially exploit, store or transmit material from the Services without our prior written permission.
North & Noel names, logos, illustrations, product designs and other brand elements may not be used commercially without our prior written permission.
Shopify's trademarks and other third-party trademarks remain the property of their respective owners.
All rights not expressly granted are reserved.

We may provide access to tools or services operated by third parties.
Such tools may be provided on an “as available” basis and may be subject to separate terms and privacy policies from the relevant provider.
We are not responsible for the operation of third-party services where responsibility legally rests with that third party.
Any new features, tools or resources introduced through the Services may also be subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites, platforms or services operated by third parties.
We are not responsible for the content, availability, accuracy, security or practices of third-party websites that are outside our control.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
North & Noel is powered by Shopify, which enables us to provide the Services to you.
However, any sales and purchases you make in our Store are made directly with North & Noel.
By using the Services, you acknowledge and agree that Shopify is not the seller of products purchased from North & Noel.
To the extent permitted by applicable law, Shopify is not responsible for claims arising solely from products sold by North & Noel.
Nothing in this section limits any rights or remedies that cannot legally be excluded.
SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because our store is hosted by Shopify, Shopify also processes certain information in order to provide its platform and related services.
Information may also be processed by service providers involved in payments, fulfilment, shipping, analytics, customer support and other functions necessary to operate the store.

SECTION 11 - FEEDBACK AND REVIEWS
If you submit reviews, suggestions, feedback, photographs or other content relating to North & Noel or our products, you confirm that you have the necessary rights to provide that material.

We reserve the right to correct such errors and update information.
If an error materially affects an order you have already placed, we will handle the matter in accordance with applicable consumer law and, where appropriate, contact you before proceeding.

To the fullest extent permitted by applicable law, North & Noel and Mavo Music AS shall not be liable for indirect, incidental or consequential losses arising from use of the Services where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
In particular, nothing in these Terms limits mandatory consumer protections, liability for intentional misconduct, gross negligence, personal injury where liability cannot legally be excluded, or other rights that cannot lawfully be waived.
SECTION 18 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for losses or claims resulting from your unlawful use of the Services, your material breach of these Terms or your infringement of another person's rights.
This provision does not impose liability on consumers beyond what is permitted by applicable law.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
Failure by us to enforce a provision of these Terms does not constitute a permanent waiver of that provision.
These Terms, together with policies expressly incorporated into them, constitute the agreement governing use of the Services and purchases made through North & Noel.
Nothing in these Terms overrides mandatory rights granted by applicable law.

You may not transfer your contractual rights or obligations under these Terms where doing so would materially affect our rights without our consent, except where applicable law provides otherwise.
We may transfer our rights and obligations in connection with a legitimate transfer, restructuring or sale of our business, provided that this does not reduce mandatory consumer protections.

These Terms of Service and agreements relating to purchases from North & Noel are governed by the laws of Norway.
Nothing in these Terms limits any mandatory consumer rights or protections available to you under the laws applicable in your country of residence.
Any dispute shall be subject to the competent courts of Norway, except where mandatory consumer protection law gives you the right to bring a claim in another jurisdiction.

Headings are included for convenience only and do not affect the interpretation of these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
The current version of these Terms will be available through our website.
We may update these Terms from time to time.

Changes will not retrospectively reduce rights you already have in relation to an order placed before the change.
